Starting January 1, 2025, significant legal changes will come into effect, requiring businesses to use electronic invoices in their transactions.
Legal Foundations:
Germany:
The Growth Opportunities Act of March 27, 2024, introduced the obligation to use e-invoices in the B2B sector. Starting January 1, 2025, all companies based in Germany must be able to receive and process e-invoices. The issuance of e-invoices will gradually become mandatory for all companies by 2028.
European Union:
EU Directive 2014/55/EU on electronic invoicing in public procurement establishes the framework for the introduction of e-invoices. The goal is to combat VAT fraud and promote digitalization.
Requirements for E-Invoices:
An e-invoice must be in a structured electronic format that allows for automated and electronic processing. Formats like PDF or JPEG do not meet these requirements. In Germany, the XRechnung and ZUGFeRD formats (from version 2.0.1 onwards) are recognized as they comply with European standards.
