Add an optional, non-required "Marketing/SMS Consent" checkbox as a native field inside the One-Step Order Form / Checkout element — configurable independently from the Terms & Conditions checkbox (own label text, own default state, own required/optional toggle), and whose checked state is written to a contact custom field or order attribute so it can be used as a trigger condition in Workflows without a workaround.
Business impact:
GHL is built around email and SMS marketing automation (workflows, Klaviyo/native SMS, etc.), but for a store built on the One-Step Order Form, there's no first-party way to capture consent that (a) is legally separable from required purchase terms, and (b) writes to a queryable contact/order field that workflows can key off of. This forces merchants into one of two bad options: bundle marketing consent into the required T&C checkbox (works for email, but SMS/TCPA rules explicitly prohibit conditioning SMS consent on completing a purchase), or build a second, separate Form/Survey checkbox elsewhere in the funnel — which adds a friction step outside the checkout flow and is easy to miss/skip.
Merchants running SMS workflows through GHL are the ones most exposed to TCPA risk if the only available checkbox bundles SMS consent with a required purchase condition. A native, unbundled, optional consent checkbox closes that gap.
