Checkout terms and condition check box UX for better conversion

The way the check box on the terms and condition work now in the checkout element is very detrimental to conversion.
When the check box is not check they pay buttons (PayPal, cards...) are inactive. You can't click on them. They become clickable only if the checkbox is checked.
It is a UX non sens because some clients don't understand why they can't click the payment button.
The proper UX (has seen on most checkouts out there) should be. If the checkbox is not checked you can still click on the payment/PayPal buttons but then you have a message in red that tells you that inorder to proceed with the payment you need to accept the terms and conditions ..
Could you fix that soon cause it is a simple UX catch that make us loose sales.
